These Terms and Conditions govern your use of the Website and any transactions conducted with Matthew Pomfret Ltd ("Matthew Pomfret”, "we", "us" or "our") provides the services available on the Website. By using any part of this Website, registering as a customer, or placing an order, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not use this Website. This document provides key information about our company and the terms under which we offer bespoke furniture for sale, restoration, and joinery services. Please review these terms carefully before making a purchase, as placing an order confirms your acceptance. Our terms are updated periodically to reflect any changes in our policies or practices.

Order Confirmation & Payment Terms

  • A 75% deposit is required to confirm all orders and begin production. Delays in receiving deposits will impact delivery timelines.

  • Changes to specifications after placing the deposit may incur additional charges and could affect delivery timing. The balance payment is due before collection or delivery.

  • Preferred payment is by bank transfer, with bank details included on your invoice.

  • All pieces remain the property of Matthew Pomfret until they are paid in full.

Delivery & Collection

  • Delivery charges are not included in item prices unless explicitly stated. We can provide quotes for local and international delivery upon request.

  • You are welcome to arrange collection of your pieces directly from our workshop on an agreed date. Please note that we cannot accept responsibility for items damaged in transit once they leave our premises.

  • While we strive to meet agreed delivery dates, occasional adjustments may be necessary due to unforeseen circumstances. If a change is required, we will notify you at least 14 days in advance to arrange a new delivery date.

  • If you wish to change the agreed delivery or collection date, please provide at least 14 days notice. Changes requested within 14 days of the scheduled date may incur additional charges.

  • If bespoke or restored items are not collected within 7 days of completion, storage fees will apply. For more information on the fixed weekly fee please contact enquiries@matthewpomfret.com

  • Items uncollected within 3 months without arranged storage or a future delivery/collection date will be resold, with no refund given.

Product Specifications, Fitting, and Confidentiality

  • We strive to depict items accurately; however, variations in colour and detail may occur due to screen settings.

  • Each piece is crafted to specification, but slight dimensional variations may occur as part of the handmade process. Ensure that item sizes are reviewed carefully, and confirm that your space can accommodate the piece. We cannot accept returns for items that do not fit through doorways or are otherwise unsuitable for the intended space.

  • If access is a concern, we can recommend professional removal services—please notify us when placing your order.

  • All drawings, samples, and pricing provided during the commission process are confidential. Sharing this information requires our prior approval.

  • Inspect items upon delivery to confirm they meet your expectations in quality and specification.

Restoration Services

For clients seeking restoration work, please note the following:

  • Assessment & Details: We will request detailed information about the item, including photographs, dimensions, condition, and specific restoration needs, to assess the project accurately.

  • Project Timeline: Restoration timelines vary depending on the item’s condition and the complexity of the work required. Estimated completion dates will be discussed initially but may be adjusted if unforeseen needs arise.

  • Delivery Timing: Items for restoration should not be delivered more than 1 week before the scheduled start date unless otherwise agreed. Early deliveries will incur a fixed storage fee per item, that will be added to the final invoice.

  • Collection of Restored Items: Once restoration is complete, the item must be collected within 7 days. Delayed collection incurs storage fees. For more information on the fixed weekly fee please contact enquiries@matthewpomfret.com

  • Liability: While we handle all items with care, we cannot be held responsible for inherent structural weaknesses or damage revealed during restoration due to the item’s age or condition. Any such issues will be communicated promptly, and additional repair costs will be discussed with you.

Returns & Exchanges

  • All bespoke, made-to-order or customises pieces are non-refundable and non-returnable. As custom pieces are crafted to your specifications, they can only be exchanged if they arrive with a fault. Report any issues within 5 days of delivery or collection to arrange for an assessment.

  • Exchanges do not cover delivery or collection costs.

  • You are responsible for return shipping costs and ensuring goods reach us safely. We strongly recommend obtaining proof of postage.

Cancellations

  • You may cancel your purchase within 7 working days of placing your order.

  • Cancellation requests beyond the seven-day period for made-to-measure and bespoke furniture are subject to our discretion and apply only before dispatch; cancellations are not accepted once an order has been delivered.

Warranty and Liability

Following our care guidelines should ensure years of reliable use for your item.

  • We ensure that our items match their descriptions in quotations and invoices and, to the best of our knowledge, are free from material defects at delivery.

  • Exclusions from Warranty:

    • Normal wear and tear, intentional damage, improper storage, or adverse environmental conditions.

    • Accidents, negligence, or misuse by you or a third party.

    • Any unauthorised alterations, repairs, or modifications.

    • Use outside the intended purpose or contrary to our care instructions.

  • Our products are intended for private, domestic use only. Warranties are not provided for commercial, business, or industrial use unless specifically agreed upon. We are not liable for any loss of profit, business, operational interruptions, or business opportunities related to the use of our products.

  • We are happy to provide a quote for repairs or restoration outside the warranty period.

  • Our liability is limited to the original purchase price of the item.

  • Any guidance provided by us, whether in person, by phone, or online, is given in good faith to help you achieve the best results. However, this advice does not constitute a guarantee of product suitability or longevity unless agreed upon in writing.

Handling, Repairs, and Damage

  • If your Matthew Pomfret furniture is found to be damaged upon delivery, we retain the right to perform necessary repairs before offering a replacement.

  • In cases where damage occurs during transit, we will work directly with the delivery service to address the issue swiftly and on your behalf.

  • For any accidental damage or mishandling within your home, including the use of cleaning products or methods outside our care recommendations, we may offer a repair or refinishing service at an additional cost.   • Please be aware that any repair or alteration by an unauthorised third party will void the warranty, unless agreed with us in advance and confirmed in writing.

Materials & Finishing

  • Each piece is handmade, which may result in natural variations in texture, grain, and colour. Please discuss specific finish requirements with us before confirming your order.

  • Wood responds to environmental moisture changes. We use wood seasoned to suit our local climate, and all pieces are crafted to accommodate these changes. We cannot accept returns for dimensional or structural issues caused by environmental conditions once the piece leaves our workshop.

  • Care Recommendations: To preserve wood finishes, apply a suitable wax or oil every 3–6 months. Use a soft cloth for cleaning and avoid harsh chemicals or abrasives. We are not liable for damage caused by improper care or unsuitable cleaning products.

Licences, Permissions & Approvals

  • By placing a bespoke order with us, you confirm that you have obtained any necessary licences, permissions, or approvals required for commissioning and receiving bespoke products.

Intellectual Property, Media, & Photography Rights

  • All design concepts, images, and intellectual property related to our products, including commissioned pieces, remain the property of Matthew Pomfret. This information is strictly for personal use and must not be disclosed to or commissioned by any third party. Any unauthorised use or infringements will be addressed with strict action.

  • Unless agreed otherwise in writing, we reserve the right to use images of completed work for marketing and promotional purposes. This includes, but is not limited to, use on social media, websites, and printed materials.

  • For projects completed prior to the introduction of this policy on 01 November 2023, we reserve the right to use existing photographs of the work for promotional purposes. Every effort will be made to ensure such photographs do not disclose sensitive client information or identifiable details. If a past client has specific concerns regarding the use of photographs of their project, they are encouraged to contact us directly to discuss and address the matter.

  • For new projects, clients are welcome to share preferences regarding the timing, context, or exclusivity of published photographs at the outset of the project. This ensures the work is presented in a way that highlights the craftsmanship involved while respecting the client’s preferences.

  • If a client wishes to restrict the photography or publication of their work entirely, this must be explicitly agreed upon in writing prior to the commencement of the project.

Website Usage

  • We endeavour to ensure our website is secure and free of harmful software. However, we are not liable for any potential damage to your device resulting from site use.
